The Notwithstanding Clause: Recent Developments and Debates

SPEAKER: Professor Robert Leckey, McGill University 

The notwithstanding clause in the Canadian Charter of Rights and Freedoms has been making headlines, including with recent uses by the legislatures of Quebec, Ontario, and Saskatchewan. Meanwhile, scholars have proposed strategies for advocates to work around the notwithstanding clause and called into question assumptions about what its use means for courts and for the public. This talk will bring participants up to speed, helping them to be more informed citizens and advocates.

Attendance at this MBA Section meeting can be applied towards your Law Society of Manitoba’s Continuing Professional Development requirement for a maximum of 1.5 hours.
